HVAC contractor insurance in Tennessee

HVAC Insurance Group provides HVAC contractor insurance in Tennessee: general liability, workers' comp, service-van auto, tools and installation floaters, and license bonds, quoted across 12+ A-rated carriers.

In Tennessee, a $25,000 job is where the state takes over HVAC licensing. At that line you need a Board for Licensing Contractors license with the CMC-C or CMC classification, plus proof of liability and workers' comp. Below it, Nashville, Memphis and Chattanooga run their own licenses and bonds.

What a Tennessee CMC-C license makes you carry

Tennessee's HVAC license is built around job size. The state steps in at $25,000, and once it does, it asks for both general liability and workers' comp before it will license or renew you.

Who licenses HVAC contractors in Tennessee

Tennessee's Department of Commerce and Insurance houses the Board for Licensing Contractors, which issues licenses under Title 62, chapter 6. You need a state license before you bid or contract on a project of $25,000 or more, whether you're the prime or a sub whose HVAC portion hits $25,000.

The HVAC classifications sit under mechanical:

  • CMC-C: HVAC, refrigeration and gas piping, including solar HVAC and geothermal.
  • CMC: full mechanical, covering plumbing, HVAC and gas.
  • CMC-H: temperature controls.

CMC and CMC-C require a trade exam, though a comparable proctored city exam may support a waiver request. Each license also carries a monetary limit, set from a CPA-prepared financial statement. The state licenses the company, not individual techs; some cities license people separately.

On a bid of $25,000 or more, the prime contractor must print the HVAC sub's licensed name, license number, classification and expiration date on the outside of the bid envelope. A lapsed or misnamed license can sink the whole bid.

Liability limits that follow your monetary limit

The Board's general liability minimum climbs with the license's monetary limit:

  • Monetary limit up to $500,000: at least $100,000 in general liability.
  • $500,001 to $1,500,000: at least $500,000.
  • Over $1,500,000, up to unlimited: at least $1,000,000.

The certificate must be in the exact name being licensed, matching your financial statement, and list the Board as certificate holder. Workers' comp proof is due too: a comp certificate, a Construction Services Provider exemption registration, or the Board's exemption questionnaire, at application and every renewal. There's no state license bond for an ordinary contractor license. Confirm the current requirement with the Tennessee Board for Licensing Contractors.

In counties that adopted it, including Davidson, a home improvement license covers residential remodeling jobs between $3,000 and $25,000. The Board's summary lets that license holder show general liability, workers' comp or a bond, with a $100,000 GL minimum for that tier. Whether a stand-alone HVAC replacement falls under it isn't clear, so check with the Board. Vertical closed-loop geothermal jobs also need the well driller's state license information listed. Below $25,000, cities set the rules: Nashville, Memphis, Chattanooga and Knoxville each run their own system. Any tech handling refrigerant needs federal EPA Section 608 certification as well. Tennessee workers' comp covers HVAC owners too

Tennessee treats construction differently. Construction businesses, HVAC included, must carry comp for everyone, owners too, unless the owners register as exempt. Non-construction businesses don't need it until five employees.

Owners get out of the rule only by registering on the Workers' Compensation Exemption Registry, which the Bureau of Workers' Compensation keeps. Eligible owners are corporate officers, LLC members and partners owning at least 20%, sole proprietors who own 100% of the business, and family members who together own at least 95% of it. A business can exempt up to five people, and each exemption lasts two years. The exemption covers only the owner named on it. Employees aren't eligible, and exempt owners still have to cover every employee, even a single one.

Skip required comp and the Bureau's penalty is one and a half times the dodged premium; repeat offenders within five years can owe triple. Nashville also wants comp proof, or an exemption affidavit, before you pull permits. See the Bureau of Workers' Compensation for current rules, and workers' comp for HVAC contractors for how audits work.

Ranked for a state where the license, the comp rule and the city bonds all move together.

General liability

The Board's minimum rises from $100,000 to $1,000,000 as your monetary limit grows. HVAC general liability

Workers' comp

Required for construction businesses, owners included unless they're on the exemption registry. Comp for HVAC shops

Permit bonds

Nashville and Memphis each want their own bond before you pull permits. HVAC license and permit bonds

Umbrella

Commercial GCs often want limits above the Board's floor, and an umbrella is the usual way there. HVAC umbrella coverage

Commercial auto

Service vans crossing between city permit systems still need one auto policy that lists every driver. Commercial auto for HVAC

Tennessee risks that change your HVAC coverage

Two of Tennessee's biggest HVAC risks are paperwork with real money behind it. The third arrives with the gas line.

No grace period on an expired license

The Board says it plainly: there's no grace period. Contracting on an expired license is unlicensed activity, and bidding under any name other than your exact licensed name counts as unlicensed too. For an HVAC sub, a lapsed license can also void the prime's bid listing, which costs the GC the job and you the relationship.

Owners off the comp policy by accident

Because construction comp includes owners, an owner who never registered as exempt is covered by the rule but may not be on the policy. If that owner falls off a ladder pulling a condenser, the gap shows up at the worst time. Check the registry before you renew, and check it again when you add a partner or member.

Example scenario: Two partners in a Murfreesboro HVAC shop each own half the business. One registered as exempt years ago; the other assumed he was covered the same way and never filed. When he breaks a wrist on a rooftop service call, the shop learns he was neither exempt nor listed on its comp policy.

Gas piping and carbon monoxide wording

The CMC-C classification includes gas piping, and a CMC-C holder may run gas piping to appliances. That puts furnace connections, venting and appliance hookups squarely in a Tennessee HVAC shop's scope. The answer to a carbon monoxide claim lives in your policy's endorsements. A total pollution exclusion or a carrier CO exclusion can shrink coverage, and courts haven't settled whether CO is a pollutant. Have us mark the CO language on any Tennessee quote before you sign.

Tennessee cities where we insure HVAC shops

Nashville

Metro Nashville registers mechanical contractors under Metro Code 16.16.780, and the firm's Master Mechanical, HVAC&R or Gas and Appliance certificate holder must be employed full time. Metro's 2020 contractor requirements also call for a permit bond, $10,000 for jobs under $25,000 or $40,000 for jobs of $25,000 and up, so confirm the current figure. That's a second permit bond on top of state licensing.

Memphis

Memphis and Shelby County share one joint code. Since the 2021 joint ordinances, the 2021 International Mechanical Code with local amendments is the Memphis and Shelby County Mechanical Code, enforced by the joint Office of Construction Code Enforcement. The local amendments carry their own contractor registration and bond rules, so ask the Building Official for the current bond amount and filings before you pull permits. Your liability policy and payroll records are worth having ready too.

Chattanooga

Chattanooga licenses mechanical people itself. A Master Mechanical license takes three or more years as a Class 1 or 2 HVAC or sheet metal journeyman, or the equivalent, plus an exam, and gas piping needs a separate city gas license. Journeymen on your payroll are employees, so they belong on your workers' comp policy.

Knoxville

Knoxville has contractors register before they pull permits, and different types of work call for particular registration types, sometimes alongside a Tennessee state license. As of 2022, the city doesn't require a bond for subcontractor licenses. Make sure your general liability fits the work you register for.

What Tennessee HVAC insurance costs

Tennessee sets a liability floor by rule, and it rises as your license does. A shop with a monetary limit over $1.5 million starts at $1,000,000 in general liability, while a smaller shop starts at $100,000. Comp for owners, city permit bonds and the limits your GCs ask for come next.

Other Tennessee factors we ask about:

  • Your monetary limit, and whether you plan to raise it this year.
  • Who's exempt. Which owners are on the state's exemption registry and which are on the policy.
  • Where you pull permits. Nashville and Memphis bonds each carry a premium.
  • Gas work. How much furnace and appliance piping you do under your CMC-C.

What you pay depends on your payroll by class code, your annual revenue, your mix of installation and service work, residential versus commercial jobs, the vans you run, your claims history and the limits you pick. A licensed agent reviews your answers before quoting. See the HVAC insurance cost guide for published ranges.

Tennessee HVAC insurance questions

Do I need a license to do HVAC work in Tennessee under $25,000?
Not a state contractor license, in most cases. Below $25,000, cities set the rules: Nashville registers mechanical contractors, Memphis and Shelby County set registration and bond rules in their joint code, and Chattanooga licenses master and journeyman mechanics by exam. Some counties also use a home improvement license for residential jobs between $3,000 and $25,000.
How much general liability does a Tennessee CMC-C license require?
It depends on your monetary limit: $100,000 for a limit up to $500,000, $500,000 for a limit up to $1.5 million, and $1,000,000 above that. The certificate must show your exact licensed name with the Board as certificate holder. Confirm the current tiers with the Board.
Do Tennessee HVAC company owners have to be on the workers' comp policy?
In construction, yes, unless they're listed on the state's Workers' Compensation Exemption Registry. Corporate officers can qualify, LLC members and partners need a stake of 20% or more, and one business can exempt up to five people. Employees can't be exempted.
What bond do I need to pull HVAC permits in Nashville?
Metro Nashville asks for a permit bond of $10,000 for jobs under $25,000 or $40,000 for jobs of $25,000 and up, plus comp proof or an exemption affidavit. Confirm current amounts with Metro Codes before you apply.
